Getting a divorce is almost always a very emotionally tasking experience, but it can also take a toll financially. Once the legal process is set into motion, the emotional aspect gets pushed to the background when the attorney fees and court costs surface. Many couples do not really realize how much a divorce will cost and are not prepared for the expenses.
One expense that pitches in to the divorce process is if you are initiating the divorce, you will have to pay a service of process fee to have someone serve the papers on your spouse. You may have to purchase these forms, or they may be available free from the court or online. If you have a close friend who can serve the papers for free, you can save some money. But either way, you have to find someone else to do this; you can never do it yourself.
After your spouse has been made aware, you can file your papers at the family law court in the county where you are bringing the action. Each county has its own filing fee rates, but it can range anywhere between $100 and $350.
Another aspect that will determine your divorce cost is how much you pay in attorney fees. It is always best for you to hire an experienced attorney who is willing and determined to fight for your legal rights. Most of them are pretty pricey, but you get what you pay for. However, you can also get lucky and find a good attorney who does not charge outrageous fees.
If there are large marital assets or a business to divide up, your attorney may want to hire an experienced financial analyst. This will add to your divorce costs because you may need an expert to come help you negotiate your divorce settlement, and make sure you are secure in your financial needs.
Filing for a divorce is only the first step of many in this process. There may be issues such as
child custody
and
support
, legal strategy of your attorney, and division of property and debt. In the end, it is up to you and your spouse on how much the divorce will end up costing. Either you can cooperate with one another and handle it outside of the courtroom, or you can go through the (expensive) process by hiring attorneys and such.
